Welcome to moonm8. These Terms of Service ("Terms") govern your use of the moonm8 mobile application (the "App"). Please read them carefully. By using our App, you agree to be bound by these Terms.

1. Our Pledge and Your Responsibility

moonm8 is a tool designed to foster understanding and support within a relationship. By using this App, you agree to the following core principles:

• Explicit Partner Consent is Mandatory: You must have the explicit, informed, and ongoing consent of your partner to use this app to track their menstrual cycle. This means you have had a direct conversation and they have agreed to you using moonm8 for this purpose. Tracking anyone without their full knowledge and permission is a strict violation of our terms.
• Respectful Use: The information shared within the App is intended to help you build empathy and provide better support. You agree not to use this data to shame, pressure, control, or disrespect your partner in any way.
• It's About Support, Not Control: You agree to use the information provided in the App respectfully to become a more supportive and understanding partner.

2. App Functionality

moonm8 allows a user (the "Boyfriend") to understand and receive insights about his partner's (the "Girlfriend") menstrual cycle. The App is designed to facilitate better communication and support within the relationship.

3. Data and Privacy

Your privacy is paramount. The App is designed to be a private and secure space for you and your partner.

• No Data Collection by Developer: moonm8 does not collect, store, or transmit any personal data from you or your partner.
• On-Device Storage: All information entered into the App is stored locally on your device using the SwiftData framework.
• User Control: You and your partner are in complete control of the data entered into the App.
• Data Deletion: All data is permanently deleted when the App is uninstalled from the device.

4. Not a Medical Device

moonm8 provides estimates and insights based on the data provided. It is not a medical device and should not be used for:

• Medical diagnosis
• Contraception or fertility planning
• Disease prevention

Always consult a healthcare professional for health advice.

5. User Conduct

You agree not to misuse the App, including but not limited to:

• Using the App for any illegal or unauthorized purpose.
• Attempting to reverse engineer or decompile the App.
• Using the App in any manner that could damage, disable, overburden, or impair the App.

6. Intellectual Property

All content and materials within the App, including but not limited to text, graphics, logos, and software, are the property of the App developer and are protected by intellectual property laws.

7. Disclaimers and Limitation of Liability

Disclaimer of Warranties: The App is provided "as is" and "as available" without any warranties of any kind. We do not guarantee that the App will always be secure or error-free, or that it will always function without disruptions, delays, or imperfections.

Limitation of Liability: The developer of moonm8 will not be liable for any damages that arise from the use of the app. This includes, but is not limited to, any direct, indirect, incidental, punitive, and consequential damages.

8. Changes to Terms

We may modify these Terms at any time. We will notify you of any changes by posting the new Terms within the App. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer is based, without regard to its conflict of law provisions.
